Ziffski what they did was not illegal. They can arrest you without a arrest warrent if you are underage and have beer with you by law or if it was not a law then with good intentions they can do that. Besides its not like there gonna keep you at there jail. They are gonna keep you there for the night, confiscate the beer and car and release you the morning to stop whatever you were going to do.

drjayphd: Well, not if he accidentally said "don't look in the trunk". Then you KNOW they're gonna check the trunk. The problem is that MOST people will agree to let the officers check the car because they don't want to end up in what they perceive would be a worse situation. |

In many states if your a minor and even if you buy it for a adult you cant handle beer.. at all. the only way you can have beer as a minor "in wisconsin" is if you are with a adult and even then if you stray away from them and are finishing a can off and a cops sees you. you get locked up. So its pretty stupid to drink as a minor.

It's kind of a screwy Catch 22. The point of the designated driver is to keep drunkards from driving. But the DD couldn't have let the 21 year old drive b/c he was drunk. If the 21 year old would have been driving, the 20 year old would have been fine. The way that laws works is whoever is driving is the possessor. Then again, he also could have saved his ass by not allowing the search I guess...
