Backing up? You're the only one continuing to argue about ROM distribution and ethics. I've already stated several times that distributing ROMs without permission is illegal. What else do you want? I've already covered the "ethics" thing by stating that it's ILLEGAL. I'm not touching morality in my argument, since morality is mostly subjective within the context of this argument. I'm only discussing what the law says.

Whatever. I'm not getting anywhere with any of you with this thread and none of you are able to provide accurate information unless the intake of a third party (a different board altogether, which I'm not doing). I'll stop this thread, then.

And now. When I'm ever in doubt about copy right laws, I always look to other media! Is it illegal to copy a phrase or a word from a book and put it into your own paper AS LONG AS YOU GIVE CREDIT VIA BIBLIOGRAPHY AND CITATIONS? Of course not! Is it illegal to pick your favorite songs from your CD's and put them in a mix album? Of course not! Is it illegal to take a song, modify it as a remix and distribute it in a club? I don't believe so. So why is it illegal to hack a ROM?

The copyright law ONLY states that the original author has full rights to recreate, publish, distribute and sell his original work. It does not say you cannot mutilate that work for your own personal enjoyment or tell others how you did it. It does not say you cannot take apart the work and annalyze it to death and distribute your findings. ROM Hacking essentially is taking apart a file, analyzing it and distributing your findings. The act of this and the IPS files themselves are not illegal. Only the distribution of commercial ROMs is illegal. It is not illegal to play them on an emulator, it is not illegal to use an emulator. Look at it this way: Bleem for Dreamcast was legal. If you owned a legitimate copy of a PSX game and used the DC as an emulator, that's perfectly a-ok!
