This is not right that I'm pissed at my boyfriend for getting into a fight to protect family. He has a broken rib and a ticket because of it. Now he tells me that it's his thrid misdemeanor in less than five years. So he might go to prison for two years if found guilty. I cannot handle that. RIght now I'm just pissed off, not wanting to talk to him and not going to wait till he gets out of prison if he's found guilty. So I have no idea what to do now. :_; We just started dating and this happens.

Since when is fighting a jailworthy offense? And if so, 2 years? Unless he was on probation or something.. I don't see how that's possible.
And if he was on probation and didn't tell you, maybe it's a sign that he's not all that great of a boyfriend.
I don't know why you wouldn't talk to him, that's not going to solve anything. Talking to him about it would be wise, if you want a relationship at all with him.
If your plans are to dump him because of this.. don't beat around the bush. Seriously.

I'd investigate the situation further before making any judgements but already, the prognosis is not looking good.

Well he swears on his grandma's grave that he's not going to go anywhere's as his lawyer can get him out of it. He's trying to reassure me that he's not going to go but things like this I always have a bad habit of looking on the bad side.

It's better to stay with the good side though.. I have issues with the bad side too because then I'd expect it and won't be hit by it as hard . So it was a big fight to protect the family or just something small? It had to have been big if the cops got called and stuff. Is it that 3 strikes thing? I thought they got rid of that

His family got attacked by someone? It´d help to get to know what it is about but you don´t have to tell if you don´t want to. It´s his private life after all.

I don´t see why he would go to prison because of this. I hope he´ll get out of this.

And I don´t think you should dump him because of this. He did it for his family.

They're boyfriend and girlfriend (albeit not very recently), and this is a little too major to argue for privacy on. She has a right to know what's going on.

That means shit was talked about his family, and he fought thusly.

Only possible reason I could see him getting two years for is if he threw the first punch and did some serious damage, this qualifies as felony assault. Either that's the case or the plantiff is exaggerating.

Is REALLY discouraging. He can't say that what he did was legally justifiable, he says his lawyer can get him out of it.

He's a scrapper with a temper, save yourself a lifetime of trouble and dump his ass.

Now "jumped in to defend a family member" is completely different, but your wording fails to convey that that is what happened.

Yeah, we can't really say a whole lot with what little was told. We can just assume that someone was talking crap about his family and that he got into it with them. It must have been bad if he could go to jail for it.

Ok his aunt's ex went over to her house and she called his cousin (Matt's) and his cousin came to get him. They were going to talk to the ex to get rid of him first before anything happened. Matt gave the guy the first three shots as he wasn't going to leave peacefully. As a result he got a broken rib before he fought back and broke the guy's arm.

Matt has sworn off fighting from now on. Now I'm just praying he gets probation instead of jail time. Otherwise I told him flat out I'm leaving if he gets two years instead of probation.

Waaaiit wait wait wait.

If this is the case, he shouldn't get jailed, let alone probation. This is self defense. (unless it was verbally antagonized, then eh... that changes things a lot)

"The general criminal law allows for the use of necessary and proportionate, non-deadly force in self-defense anytime the victim reasonably believes that unlawful force is about to be used on him."

The ex committed assault, which is unlawful force, he had more than reasonable belief that he was going to be attacked, he in fact WAS attacked, and fought back to defend himself.

Read more here This is mainly regarding Pennsylvania law, but most of these statements hold true for most of the U.S.

No person (especially an american citizen "life, liberty and the persuit of happiness", protecting life, right?), regardless of a few past minor mistakes (major laws make it subject to belief systems), should be denied his right to protect his own well being, make absolutely sure that you convey this to him and his lawyer

Well he talked to the lawyer and defense attorny today and his case looks good. Seeing as he'll be getting two and a half months probation out of it all.
