Just want to be sure I'm entirely correct on this... Let me know if any of this is incorrect by US/Canada law.

  • The only legal way to get/use a ROM is to dump it yourself from a game you own, never use it and the real copy at the same time, and not keep it if you get rid of the game.
  • Modifying software you have purchased is legal as long as you don't infringe on copyrights, distribute the software itself (patches OK, entire program not OK), disable security/copy protection mechanisms, or profit from it.
  • Modifying a game console to play copied games is legal if you have proof of purchase of the original game and don't use both copies at the same time.

1) Dumping it from your game, true; although to be honest, the checksum on a good dump would match with other good dumps so that's kind of a moot point. I'm guessing the rest is true.

2) Pretty sure that's right. I've never seen any company crack down on someone distributing IPS patches.

3) I don't think so. Given how the Xbox can lock out modded systems from playing Xbox live...

I mean, its just like copying DVDs.
Sure, you own the original thing, but you still copied it, voiding that crazy blue warning at the start of every movie.

I know game companies can try to stop you from modding consoles, but I would think they just assume that you're using illegal copies if you do. Plus they can tell you that if you modify the system you will be denied certain services even if it is legal.

well, when you think about roms, especially older ones, such as nes and snes, I dont think they would do much, even if you didnt own the original, with software, I think its kinda the same, even though you can get in trouble, its highly unlikely, so they just classify it as legal only if you own it...but who cares now anyway, most people will use pirated copy's of stuff, i know I do...

"Uhh...those are backups of my real game cartridges."

"Do you have and hardware for any of these backup games?"

"Uhh..."

"Because Roms aren't a big deal, we shall fine you $100. You have 2-3 weeks to pay. If it's late, $10 will be added each day overdue. Have a nice day sir."

"Uhh..."

-Moral of the story...big whoop if you have Roms. It's not like they have professional hacks at video game companies hacking your computer for Roms.

ROMs are illegal, no way around it. You can backup ROMs only for archiving purposes and not personal use. Just like you can't backup your car incase it breaks, you're not supposed to backup your ROM incase your cart breaks, but does it really matter? Keep downloading them ROMs and don't worry about legality issues.

HH: Well, you're breaking the warranty. Whether you're using your Xbox to play copied games or to run freeware off it, you're still messing around with that warranty so they can just shut it off from the online world. :\

Of course, people can get around that I presume.

Well I was planning to put ROM-related info on my site (not actual ROMs), so I don't think the server's location (US BTW) has much to do with it.

I believe ROM backups are similar to recording VHS tapes/CDs. You can copy your own crap all day long, so long as you don't distribute it. Then again, there only really is a question if someone actually pursues it.

IPS are okay, as it is your own work, after all. That Might fall under the free use clause, come to think of it.

Modifying the system breaches your warrantee, but no big whoop. Even then, if you take a page from Microsoft and change it just enough then put it into mass production, sure it's legal ;*)
The only real problem you may run across here is if the modification doesn't comply with FCC guidelines - ie: home-made antenae. The most important caveat here is "If you screw it up it's your responsibility, not mine".
