Last time I got beat up (which was in grade 7), it happened on school grounds. We took it to the police. The school system is stupid: "You beat someone up! YOU JUST WON A FREE VACATION!"

Anyways: He now has a criminal record! ^^

If somebody does anything off school grounds its not the schools place to punish the student. It's the parents place. I can understand the school having a problem with it, but if they do they should contact the parents and ask that they punish the child. If they claim that they want to punish the student In most cases, parents will not hesitate to. The problem with most schools is that they write in their rulebook that they can punish students for anything that they feel like, with however severe consequences they want, and that the offense could have occured anywhere. I love it when people say that school aren't the real world and that civil rights don't apply in schools. I remember hearing about a student that put something on his locker that reflected his opinion on the war with Iraq. They made him take it down and gave him a detention. He took it to court, won, and the judge educated the teachers on civil rights. My point is that teachers schools seem to think their power extends farther than it actually does. At least that is the case in my school. Fortunately many of them realize this. If you, or better yet your parents, wanted to challenge something like that they'd probably give up or at least greatly reduce the punishment.

I had a friend who made an anti school website. She went to a catholic school and she made a website saying that the nuns were evil satan worshippers that kill babies and drink their blood.

The nuns told her to remove it or they'd sue.

Wow, that was a long time ago too now, 1998 or something.

A few years ago, some people at my school made an anti-school website...on the school computers. Needless to say, it was taken down. I never got a chance to see it.

i believe this goes beyond the jurisdiction of the school since they do not have and legal ground for suspending the people involved since it didn't happen on campus. But then again, the school has responsibility of providing a safe environment for all the students and I think this is where the school feels I can act. Just because it occurs off campus doesn't mean its effects don't make it to campus.

Should it be legal? Fuck no. )Public) schools have no business regulating a kids' off-campus behavior, unless they have some reason to believe that a parent is being negligent. God, I can just imagine - "You're being suspended because you were seen off-campus wearing a shirt with an exposed midriff. Shame on you, young lady. You're suspended for a week."

If the kid's website constitutes some kind of menace, then it's a legal issue, and last time I checked, the school system was not a court.

mother-fucking-word. Remember when schools used to be about like, learning. You know, books and shit? Now the school has to bring up perfect model citizens, parent them, and apparently act as an intercepting legal system.

My friend got a 2 week suspension for making a band website that the principle found with his picture on it because of "excessive swearing and negative comments".

If it had nothing to do with school life itself, I'd seriously call that lawsuit-worthy. God forbid a student uses his/her LJ to badmouth another student and gets suspended for it; I'm getting a headache just thinking about it.

In short - NO.

Yes, that is a good point. A lot of parents leave the "parenting" up to their schools. Which is just a cop-out, and absolute bullshit.

When their child is upset by another child, rather than actually do some parenting, the most a lot of parents will do is go to the school and yell "What the fuck are you going to do about it?" until the school acts. As far as a lot of parents are concerned, this stuff isn't their responsibility -- even if it doesn't occur in school, the school is apparently seen as being supposed to do the work of parenting for the parent.

Grrr.. I'm getting angry now, I've actually spoken to parents like this before, and I'm getting teh shitty.

I'm so happy that my Mother didn't do any half-arsed underparenting like this.

Well also when I said "picture" it was more or less just drawings and stuff. No Actual photographs. But then again what says the kids were syaing that about that one person or if it was the person they accused in the first place? Actual parents that do their parenting job don't really exist anymore (in the majority). Just a few more things to add to it.

If you're on school grounds, school property, at the bus stop, or in sight of school grounds than they do have the right to punish you.

To answer your question. Yes. Threating bodily harm is a legal offense. Probably said some negative (but not threating) things about the student also which is Defamation of character. Sueable offense.

The kids got off lucky with only suspension.

It's probably more appropriate for parents to take it up with the parents of the children involved; however I know (from my experience in schools) that parents are much more likely to try to hold the school responsible.

That puts the school in a difficult situation, because it's harassment, but it's not actually done on the school premesis.

But because the kids involved go to the same school as the kid being harassed, parents are pretty damned likely to go to the school and yell and scream and rant rather than follow it up directly with the parents of the children involved....

Maybe also because the school is 1 central point of contact, wheras they'd have to contact 30 parents about this......

(And yes, working in schools, I've seen parents come in and hold the school responsible for things the school has no earthly control over before; they do it at a startlingly high rate)

If there was a comments like *picture* "This woman is a bitch and need to die" and ETC, then yes. I could see some legal action done.

But then, this is a so grey area.

Grey Area.

This kind of stuff just isn't cool, but I don't know who should "deal with it" and clean up the mess, so to speak.

It is not technically the direct jurisdiction of the school, but parents may still hold the school responsible for it, and so schools may still have to act upon it.

No, the school shouldn't do anything, the person parents should be the only people that can do this. The school shouldn't have any jurisdiction for what happens off grounds. Of course that was stupid... and they shouldn't have done it. Hell, if that happened in my town, everyone that even said "I wish you were dead." would go on probation. The schools suck.

It is stupid what the kids did. But if I get beat up after school, I'll only want myself protected at school. I'll bring the beating to the attention of the authorities and make myself safe.

What they did was overkill though.

Today an issue about a website that a student made (off grounds, mind you) that was offensive and possibly hurtful towards another student came up. Roughly 30 people were involved. 1 person made the website, 3 people made some images, and roughly 25 people posted hurtful things on it. So far I know of 1 person being completely suspended for a week , 1 person getting after school iss for X amount of days. These people probably were the least harmful. Neither of them made the website. One comment was: "I don't really want to kill her. I am not that cruel. I would like her to get abducted by native americans and get roasted over a fire though." Well since all of this was done off of school grounds and the only information they have is names.(Just first names except for one person who got the whole week.) So are these pluasible grounds for any action to be taken against the people who spoke their mind? Please state why you feel the way you do...

(The said website was forced to be taken down)
