Just because Rare is owned by Microsoft now does not mean they cannot do anything that pertains to Nintendo.. Rare has made several GBA titles, and at least a few DS titles as well I'm sure. Publishing some of their old games on a virtual console is not a threat to MS in any way what-so-ever, they were originally ON the Nintendo consoles to begin with, and MS isn't going to gain anything by forbidding it.
Besides, Microsoft is competing with Sony, Nintendo is more of a gray area to them, they have never shown the least bit of hostility towards Nintendo, but have been full force against Sony. Needless to say, I don't think it'll be an issue. |

So although Rare developed the DKC games, Nintendo own the rights. It's the same as the fact that EON productions own the character of James Bond. And right now, Activision own the rights to any game thats JB related. No one else can produce, develop or distribute a 007 game except for Activision. And this would include anyone re-releasing Goldeneye. |
