I have a bit of a problem. (Yes, I know, I always have problems.... that's just how my life is, okay?) See, we're moving house in a month's time, and the lease here is ending. That's fine; except for a couple of things.

Our Landlord is a bit of a jerk. The lease here is dodgy; it's not registered with the rental people like it's legally required to be, and so I have to pay the landlord in cash every month. That means that I have over a grand on me every month in cash and I walk about with it so I can give it to him.

That... I'm actually kinda over.

What now pisses me off is before the lease expires he wants some repairs done to the house. This would be normal if it weren't for the fact that the damage he wants repaired isn't damage that we did. It's damage that the previous tenants did, and he's blaming us for it. He wants a room professionally repaired and painted because of four screws the previous tenant put in the ceiling.

For starters, I'm offended that he is accusing us of the damage. And then secondly I'm really angry that he expects us to pay a professional to fix it like it's our fucking fault.

So, tomorrow when he gets his rent, I'm going to tell him to go fuck himself.

I'm going to be nicer than that though, hopefully, but he's the kind of guy who doesn't listen. He didn't listen the first time when we told him that we didn't do that to the ceiling, and we have no way of proving that it wasn't us either, simply because he didn't notice it at the first house inspection at the beginning of the lease. In fact, all he did when we told him that it was already there is give us a big long lecture about how we shouldn't put things in his walls and ceilings and how it's really naughty of us, and blah blah blah (yes, he treated us like children).

So what I want to know is.... do you think there's a way of telling him that we did not do the damage and that we refuse to pay for the repairs without it getting nasty? I know that if he pushes the issue I can always remind him that the rental agreement is dodgy... but do you think it will have to get to that?

I have had to deal with jerky landlords in the past.. in the time when I lived at home, when I was very young and my father lived with us still, he would fight with my mom and one time he broke something, Ionno what anymore, outside the condo. After the divorce, the landlord basicly tried to stick my mom with a bill for all the junk he broke in his little hissyfits over time ._.;; my mom couldn't have payed it off as well as the rent until her reimbursment from the divorce came, but eventualy it was decided that my dad would have to pay it or he couldnt transfer the lease to my mom and that mad him go nuts ^^ This landlord was very nice about it after. His wife was always really kind too, I miss her now ._.;; She played with me when I was little.

The landlord in my aunt's appartment I stay in now is kind of mean, but that's because I think he's a dork and I used to tap into his linksys with a laptop. He didn't like me very much for that ._.;; he also thinks I'm always up to no good. Stinky guy. I guess what I'm saying in all this is I can relate. You have landlord problems? That's all I know ._.;;

I'm not sure what you should do..you did not do the damage so you should not have to pay. Refuse and tell him to find the original tenents and make them, or say he should have. Or, even say it is his responsibility to keep up his own building. I hope everything works out okay.

Meh, I have learned one thing from this:

When I go to the next place, before we do ANYTHING we are going to take photos of the WHOLE PLACE. Detailed photos. Photos of the ceilings, walls, etc. Photos that prove what damage is already there, and what damage isn't. Photos of fucking EVERYTHING.

That way, if we're ever accused of damaging the place when it was there before us, we'll be able to PROVE it.

And then hopefully I won't get screwed over by the next landlord.

I think it's going to have to come down to the fact that the current rental agreement is illegal, and I am going to have to remind him of that...

Does it say in the contract that you have to leave it the way it was at the beginning of the lease? If it doesnt, then dont do anything. If it does, just assure him it will be fixed, then move out and dont do it.

If it's not a "truly legal" lease, then the landlord can't do anything about it ; he's avoiding taxes, most likely. You can even not pay the last rent and say you'll tell on him if he starts something
