Well as you all know, drunk driving is a bad thing and should be kept off the streets. That's why last night the cops had plenty of DUI checkpoints. If you get a DUI it screws with your insurance and you get a hefty fine and possibly some jail time depending on the cop and area. A lot of people, because of this, have a DD or designated driver. These are people (often friends) who choose not to drink so that everyone gets home safely. Well it doesn't pay, a friend of mine was a designated driver last night and he had a twelve-pack of Smirnoff Triple Blacks in the trunk of his car which they had forgot to bring inside when everyone was at the party. So after he had drove everyone home, he encountered a DUI checkpoint, the cops found the twelvepack in his trunk and even though he hadn't had ANYTHING to drink, because he was only 20, he spent the night in jail. So the moral of the story? It doesn't matter how old you are, if you go to a party, get smashed and crash there because you don't need to drink to be arrested for DUI. | |||

That makes no sense at all. If he's legal, passes a test and if the booze wasn't open in the car, then you can't arrest him to my knowledge. That's not DUI. | |||

Cops do weird things. Yes the age is 21 to LEGALLY drink. Seeing as everyone wants to get drunk before hand and after that age, which is just plain out DISGUSTING. I don't see no problem with this as he's obviously underage and the cops found the unopened beer in the trunk. If there was other people over 21 with him then it makes no sense to arrest him. | |||

it wasn't actually DUI, I was just making a comparison that even 100% sober underage people can be arrested at DUI checkpoints because they were helping out their friends and being a designated driver and being responsible. You can't get a DUI if you aren't actually intoxicated, no. But you can get busted for having open booze in the car, or in this case, underage posession, it would just be a different charge. | |||

I call bullshit on how they found it, though. It's in the trunk, right? Cops can't check the trunk without at least probable cause. And guess what. They didn't have it, near as I can tell. I've been stopped at my share of checkpoints, and they never ask that. The most they've done was looked to make sure everyone's wearing their seatbelts. Beyond that, a simple "had anything to drink?" is all I've had to deal with. Since they most likely couldn't legally check the trunk, there's no reason to bust him. Methinks there were some shenanigans going on there (some cop felt a need to flex nuts and didn't care about what they could legally do), or your friend has no idea about police decorum. |

If a cop asks you if he can search your car/trunk, even if they ask in a very intimidating way, and you say yes, then they have every right to search your car. Don't consent to any police search. |

I love how what the police did was illegal. If he don't blow on the breathilizer, they can't search him without appropriate warrent. God knows that denying a search has saved my ass, not for carting drugs, but for carrying illegal weapons, like switchblades. It ain't easy having to go to the ghetto to meet your friend on foot. |
