I don't mind the rating system, it at least give a good impression what you can expect from the game in terms of violence.

Thought I know a few games with too high or too low rating. SSBM got teen in Europa, then it got 7+ with the new European rating system.

From a quick Google, it looks like only Washington state has laws to that effect, but it is company policy almost everywhere. It all falls to whether or not individual employees enforce the policy. I personally used my own judgment when I worked at GameStop. Some 13 year old comes in wanting to buy GTA... not so much. But someone looking about 16-17 who knows what's going on, yeah probably.

I'd also chalk in the "parent" factor as well. If a 13-year old comes in with his parent who *KNOWS* about said game (in other words, he/she knows what the kid's getting into) then I'd sell the game to the kid. But not if the parent's being hoodwinked.
