I really don't know how much anyone knows about this, but for my own sake I think I need to make a post about it so that I have it all laid out as best as I can remember it.

So, Julie came back sometime in July of this year. When she got back, she didn't have anywhere to stay, so she stayed at my parents house while she looked for a place to live. She spent a couple weeks looking when she found a notice that basically said, 375 room and board. Pretty good for a student. So she went to check it out. When she got there, she found a family with 4 kids, living in a fairly small house. They were pretty nice, had several pets, 2 dogs specifically that Julie really liked. The room she got was fairly big. It was all for her, so it had to be bedroom and living room kind of thing.

It seemed pretty good. She paid the damage deposit and rent for August, and we moved her in. Well, they somehow covered the disgusting dog smell in that room before she came over, because when we got there, the room she was getting smelled so bad we all thought we were going to throw up. So, we cleaned it all out, scrubbed the walls, the carpet and the bathroom until they were about as clean as they will ever be. That took us about 3 hours or so. Well, after that the room seemed pretty nice. There was plenty of room for her and all her stuff. Things seemed pretty okay.

For the most part Julie didn't see them and they didn't see her (landlords). Things were pretty okay. However, over time she started to notice that the landlords were not as nice and happy as they seemed. They had regular fights late at night. On several occasions she'd come home to them drinking with their friends or smoking pot. Now, that's nothing most of us have a problem with, except they have 4 kids, in the house at the same time! Maybe I'm only really bothered by this, but the place they lived in was a dump, and they insisted on spending money on booze and weed instead of taking care of their family. Just doesn't make sense to me at all.

So, Julie was starting to not want to live there anymore (september), when her and I decided to get married in October instead of July of the next year. So, she let her landlords know sometime in the middle of the month that she was moving out, and they said it was fine cause they were going to be moving as well. Julie moved out as soon as we had found the place we are in now, and could get her stuff moved over there. The landlords here let us take possession a week or so early, because they knew about her situation. Well, time came to return the key and get the damage deposit back, and Rudy told Julie that since she hadn't given them enough notice that she was going to have to wait a bit for them to get the money together. Julie said fine, she can wait for it for a couple weeks. They demanded her key back, saying they didn't trust her keeping the key after she had moved out. So, she gave in a gave it back. A week or so passed so Julie called to see what the arrangements were going to be to get the money back. Well, she got told, quite rudely, by Rudy that she wasn't getting her damage deposit back.

Julie told my parents about it and my dad agreed to go over with her and talk to them about it, early October now, probably 1 week before the wedding. They go, Gin and Rudy agree to give it back, they just need time to get the money together. Julie calls like 2 days before the wedding, again, they tell her, tough you don't get it. She goes back with her dad, military pilot etc., and again they are told, yeah you can have it, we just don't have the money. They even had Gin go to a bank machine to prove they had no money. So, again we wait. Probably a week and a half after the wedding, we go on the agreed day to get the money, which isn't ready because they don't have cheques in, and some tax refund hasn't arrived. We leave again on the agreemant that we will return in a week and they will have all that stuff ready. Julie calls the night before to confirm, and is told that she isn't getting her damage deposit back and that if she wants it she can take them to court.

We've decided to do that, for several reasons. 1) Rudy is an asshole and we want to make him pay. 2) The room was up to standard for renting, ie. no window.... so that was illegal and shouldn't have happened. 3) No permission from the ACTUAL landlord, that's right, Rudy did not own the house he was subletting and didn't have written permission from the landlord to do so. Instead the real landlord was told that Julie was just a friend staying for a little while. And to keep Julie from talking to "the guy next door" who was the landlord, she was told he was a drunk that would get mad at her for parking in the wrong spot on the street and stuff. 4) No walkthrough of the room before or after it was cleaned. This must be done in writing if a damage deposit is given. Basically no deductions can be taken off for damamges, eventhough there weren't any and the room is now cleaner than it was. 5) The damage deposit wasn't put into an account to gain interest like it is supposed to. instead it was put towards something else, we don't know what, but it wasn't put where it should have been put. 6) Rudy is an asshole 7) Rudy has verbally threatened Julie on a number of occasions on the phone, but never on voicemail or with anyone else around... lots of swearing and the like.

Oh, and we finally found out who his landlord is. As in, we spoke to him and found out they own him over 1500 dollars in rent. There is also extensive damage on the house done by Rudy and Gin and family that this guy wants paid for. So yeah, we are both going after them. For him, it's actually about the money, for us, it's just revenge for all the shit he (rudy) has put Julie through. She shakes every time she hears his voice.

So yeah, Julie is suing for the damage deposit, court fees, interest that the damage deposit should have accumulated.... and we are also going to get a restraining order against Rudy because he is the type to come after you late at night or something (at least in our opinion).... and we want something to stop him from doing that if we can....

but yeah, that's the whole story.... it's been an annoying stressful last month or so trying to deal with them on this... but if I heard correctly, my mom and Julie are filing this tomorrow, so, it's going to be done soon I hope...

oh, and one other thing.... the landlord threw out Gin and Rudy this week, so we got a nice phone call from them again this week, so much fun!!!!

Wow that's a long, descriptive post. From what you say about these people that rented out the room to Julie. They seem to be your average liars and spend or pocket money away on other things then paying for anything that they actually need. I'm just saying, not really knowing if that's what Rudy and them actually do.

I really do hope that the court finds them guilty for not paying the landlord or Julie what they owe. Also, a room without a window is not rentable or shouldn't be rentable any ways. Besides, if someone rents out a room the landlord is suppose to show them the room but in this case seeing as they weren't the real landlords. Ugh! That's fraud of identity for renting out places.

Four kids? That's neglecting the role as parents if they smoke and drink right in front of them! But did they ever treat the kids bad i.e. abuse, lack of clothes, stuff along those lines? I think Julie should mention the things she has witnessed while staying there to the court. All I can say about the room being really disgusting before you two cleaned is that you should have taken before and after pictures as proof.

Well I'm out of things to say about this topic for now.

That sucks man. But at least they'll get what they deserve, hopefully. They sound like deadbeats. You fuck people you'll get fucked yourself in the end, I always thought.

And let this anecdote be instructive to anyone who plans to lease housing in the future. You need to watch out for yourself b/c lots of places are shady in how they handle deposits, the actual state of the housing, maintenance, etc. But this is by far the most screwed up situation I've heard of. I've been lucky enough to avoid problems with my landlords. Good luck in court.

yeah, it was a bad situation to begin with.... and everything just went... stupid.... really

and hopefully things will go smoothly.... I really don't want this to take very long.... it'll be annoying if this drags on for any reason...


the tough/annoying part is going to be getting money from them once we get the decision.... but, we are doing this more on principle than anything....

we don't need the money too badly.... but, we are going to get him for all we can.... and screw them over as much as we can for giving us this much grief about it

You're very likely to get your damage deposit back, since they never did a walkthrough AND aren't the proprietors anyway. Especially if you get the real landlord backing you up. Atleast you guys landed a decent place now; it took my mom many more tries to find an appartment were the landlords weren't trying to screw her over in one way or another. Good luck.

Ziff: trust me.... we are going to talk to social services (or whatever they are called) and tell them about the conditions those kids live in.... because it's not right... at all


sofie: yeah... thigns are better now... by far... although our new landlords aren't perfect.... they definately aren't trying to screw us over in any way as far as we know.... everything was done with paperwork and stuff so it's at least more legal than it was before...

but yeah.... we just served the papers... well, the mail will be serving the papers.... so, I'll update when we have a date and such and how things go
